Class 7219
Code 7219 applies to employers that haul general merchandise under contract for one or more individuals or concerns, provided such operations are not otherwise classified in the manual. The classification includes incidental rigging when performed by these truckers. It is not applied to specialty trucking operations described at the end of this scope. It should be noted that there is an important distinction between Code 7219 and Code 7380—Drivers, Chauffeurs, Messengers, and Their Helpers NOC—Commercial. While both apply only if they are “not otherwise classified” (NOC codes), Code 7219 applies to the transportation of goods not owned by the employer, whereas Code 7380 applies to the driving of vehicles and/or the transportation of goods owned by the employer. Trucking concerns usually maintain terminals, central loading platforms, or a temporary storage depot where merchandise is stored for a short period pending transfer to another destination. Platform persons that load or unload merchandise, as well as miscellaneous employees such as terminal employees, garage employees, and repairers, are considered an integral part of trucking operations and are assigned to Code 7219. Additionally, bona fide drivers of employers classified to the stevedoring codes—7309F, 7317F, and 7327F—or the freight-handling codes—7350F and 7360—are assigned to Code 7219. Trucking operations which are not classified to Code 7219 include Mail, Parcel or Package Delivery (assign Code 7231); and Parcel or Package Delivery from retail stores to customers under long-term contracts (assign Code 7230). In view of restrictions for these codes, their scopes should be carefully reviewed to determine whether or not Code 7219 may still be applicable to operations of this nature. Also, Code 7219 includes automobile haul away or drive away operations when such operations are performed by specialists having no equity in the automobiles being transported; Mail, Parcel or Package Delivery—Under Contract with the U.S. Postal Service; transportation of Oil Field Equipment. Code 7219 is also applied to employers that haul explosives or ammunition under contract for one or more individuals or concerns. Code 7219 also applies to drivers of concrete ready-mix operations when the materials are not owned by the employer, either while in storage or in transit. When the employer’s contract involves only trucking of premixed concrete ingredients or trucking including the concurrent concrete mixing in transit, all operations incidental to the loading of trucks and delivery of concrete are assigned to Code 7219. Refer to Code 8232—Concrete Ready-Mix Dealer & Yard Employees, Drivers for additional classification procedures applicable to ready-mix concrete dealers. Jobs consisting only of hauling snow under contract shall be assigned to Code 7219. Towing is assigned to Code 7219 with the following exception: When gross receipts for automobile mechanical services and or roadside assistance exceeds more than 50% of gross receipts for an employer who also conducts towing, assign Code 8380 to all operations. For employers with multiple locations, the 7219 / 8380 test is applied separately to each location. The operation of impound lots by towing companies is also subject to Code 7219. Therefore, all income from the impound operations is considered to be towing revenue. Mobile home delivery by specialist contractors falls within this scope. Special Conditions: When trucking operations constitute a secondary business conducted as a separate undertaking or enterprise, the payroll of an individual may be divided and allocated to a classification other than Code 7219. This may occur when employers use their trucks during a portion of a trip to haul goods owned by them and use the same vehicles on another portion of the trip to haul goods owned by others. Provided that MA Manual rules are met, Code 7219 or another appropriate trucking code applies when the employer hauls goods belonging to others on one portion of a trip. Code 7380 or another appropriate class that includes drivers may be assigned to the portion of the trip devoted exclusively to hauling goods owned by the employer. Extraterritorial Classification Guidelines: The following material was developed by NCCI to be used as a guide by auditors and underwriters in the determination of premium for trucking with extraterritorial employments where no company guidelines have been established for this purpose. The payroll of drivers, chauffeurs, and helpers for truckers will be assigned to the state in which the base terminal from which they load, unload, store, or transfer freight on a regular basis is located. Example: A trucker residing in State A has a base terminal in State B. If the driver travels regularly to the base terminal in State B to load or unload freight, the trucker’s payroll will be assigned to State B. When the driver, chauffeur, or helper does not operate from a base terminal, a determination will be made as to where the exposure lies. In that case, payroll will be assigned as follows: 1. If it can be established that a trucker spends a majority of driving time in a specific state, the trucker’s payroll will be assigned to that state. 2. If a base terminal or state of majority driving time cannot be established and the trucker is traveling from their state of residence, payroll will be assigned to the trucker’s state of residence. For purposes of these procedures, the following definitions apply: Base Terminal: A permanent location with central loading docks and/or storage facilities where a trucker regularly goes to load, unload, store, or transfer freight. State of Residence: The state in which the trucker resides as evidenced by the location used for the filing of federal income tax. Regular: A pattern of 40 hours per week or any other pattern that appears on a continual basis. Code 7219 includes incidental rigging that is performed by truckers that are not in the business of rigging but may perform these activities as an accommodation on an infrequent basis. DISPATCHERS—CLASSIFICATION PROCEDURE FOR: Dispatchers are employees that send aircraft, automobiles, trucks, trains, or vessels to specific destinations. The title “dispatcher” does not in and of itself qualify an employee so designated to be automatically classified to Code 8810—Clerical. As with any other clerical assignment, the employee who is being considered for assignment to Code 8810 must meet MA Manual requirements for assignment to this classification. In the event a dispatcher does not qualify for assignment to Code 8810, the dispatcher is classified to the appropriate basic classification(s) applicable to the business.
